Terms of Use

Effective: September 2026. These terms apply to the website fivebite.app, the Fivebite 7-Day Plan sold on it, and the Fivebite app for iPhone. They are an agreement between you and Berrymore MB, Vilnius, Lithuania ("we"). Contact: hello@fivebite.app.

By using the website or the app you agree to these terms. If you do not agree, please do not use them. How we handle your data is described in the Privacy Policy and the Consumer Health Data Privacy Policy.

Not medical advice

Fivebite provides general nutrition information, a food plan built from the protein target you enter and, in the app, a personal diary. It is not medical advice, diagnosis, or treatment, and it does not replace your clinician. We are not a medical provider. Your protein target should come from your clinician. Talk to them before changing what you eat, especially if you have a medical condition, kidney disease, or take medication. If you cannot eat or drink, contact your clinician.

In the app, this means:

  • Fivebite is a diary and a planner. It does not diagnose anything, and it does not interpret your symptoms or your entries.
  • It does not calculate, convert, check or suggest medication doses. The medication log is your own record, saved exactly as you type it. Questions about doses belong with your prescriber or pharmacist.
  • It does not check your entries for warning signs, and no one at Fivebite monitors them. If you mark a symptom as severe, the app shows everyone the same general reminder: contact a healthcare provider, and call 911 in an emergency. Logging a symptom does not tell a clinician anything.
  • The page "When to call your clinician" is general information, the same for everyone. It is not based on what you logged.
  • Reminders are a convenience. Your iPhone can delay or silence them. Do not rely on Fivebite as your only reminder to take a medication.

Fivebite is a diary, not medical advice. Check with your clinician before making medical decisions.

If you think you may have a medical emergency, call 911.

Who can use Fivebite

Fivebite is for adults aged 18 and over. By using it you confirm that you are 18 or older. The app is offered only in the United States App Store and is meant for people living in the United States.

Part 1. The website and the 7-Day Plan

What the plan is

The Fivebite 7-Day Plan is a digital product: a personal web page and a PDF file with seven days of five small portions each, protein grams per portion, gentle swaps, a list of gentle foods, a shopping list, and tips for hard days. Protein values come from public nutrition databases (USDA FoodData Central) and are rounded. Portions are suggestions. You are responsible for choosing foods that are safe for you, including allergies and intolerances, and for reading product labels.

Buying the plan

The plan is no longer sold: as of 22 September 2026 the website offers the free test and the app, and nothing on it can be bought. If you bought the plan before that date, the links in your email keep working for one year from purchase, and hello@fivebite.app will send them again if you lose them. Until then the plan cost $9, paid once through Stripe; it was never a subscription and nothing renewed.

Refunds for the plan

Email hello@fivebite.app within 30 days of purchase from the address you paid with and we refund the full $9 to the same payment method, no questions asked. Details are in the Refund Policy. This refund promise is for the 7-Day Plan bought on our website. Subscriptions bought in the app are handled by Apple, as explained below.

Personal use

The plan is for your personal use. Please don't resell it or publish it. You are welcome to share it with your clinician.

Reserving the app

Reserving the Fivebite app on our website is free and does not create a purchase or a contract. No payment method is collected. We may change or cancel the launch, the price, or the product. The app's plans and prices are the ones shown in the app when you buy. They may differ from a price shown when you reserved.

Emails

By entering your email on the website you agree to receive your result and occasional emails from Fivebite. You can unsubscribe at any time using the link in any email.

Part 2. The Fivebite app

The free diary and Fivebite Plus

You can use the basic diary for free. It includes:

  • your protein goal and your total for the day, water, how you feel, bowel movements and weight;
  • the food log: food list, saved foods, same as yesterday, and grams typed by hand;
  • the optional medication log, with reminders on your own schedule;
  • your diary, the Apple Health connection, the evening check-in and water reminders;
  • the times and grams of your five bites, and two counts on the Week screen: days you reached your protein goal and days you checked in.

Fivebite Plus is paid: as a subscription, or as a one-time Lifetime purchase where the app offers it. It adds:

  • the foods and gentler options in your 5-bite plan, and bite reminders;
  • the AI tools: photo, voice, label, "What can I eat now?" and the weekly review;
  • the full Week screen.

What is included in the free diary and in Fivebite Plus may change as the app develops.

Subscription terms

  • Plans and prices (United States): Fivebite Plus for 1 week at $6.99, 1 month at $14.99, or 3 months at $29.99. Apple may add sales tax where it applies. The app may not offer every plan to everyone. The plan and the price shown in the app when you buy are the ones that apply.
  • Introductory offer. Right after setup, a new user may be offered the 3-month plan with the first month at $0.99. After that month it continues at $29.99 every 3 months until you cancel. The offer is shown for one hour and is not repeated.
  • Lifetime. Some users are offered Fivebite Plus Lifetime: one payment of $49.99 that unlocks Fivebite Plus on your Apple Account for as long as we offer the app. Nothing renews and nothing is charged again. The AI tools keep the same daily limits as on every other plan (see Fair use).
  • No free trial. You are charged when you confirm the purchase.
  • Billing. Payment is charged to your Apple Account (Apple ID) by Apple, not by us. We never see your card.
  • Automatic renewal. The subscription renews automatically for the same period and at the same price until you cancel. Your Apple Account is charged for the renewal within 24 hours before the current period ends.
  • Cancelling. Cancel at any time in iPhone Settings → your name → Subscriptions, at least 24 hours before the renewal date. You keep Fivebite Plus until the end of the period you paid for. After that the app goes back to the free diary, and your entries stay.
  • Deleting the app or your Fivebite account does not cancel the subscription. Only cancelling with Apple does.
  • Refunds. Apple takes the payment, so refunds for App Store purchases are decided by Apple under its own rules. Ask at reportaproblem.apple.com. We cannot issue App Store refunds ourselves, and the 30-day refund for the website plan does not cover app subscriptions. Nothing here limits a refund right that the law gives you.
  • Price changes. If the price of your plan ever changes, you will be told in advance, and Apple's rules for subscription price changes apply.
  • Restoring. If you reinstall the app or change phones, use Restore purchases in Me → Subscription with the same Apple Account. This restores a Lifetime purchase too.

Your account and your diary

The app creates an anonymous account for you automatically. Sign in with Apple is optional. It keeps your diary with your Apple Account, so it comes back on a new iPhone. Without it, your diary is tied to your iPhone, and we may not be able to bring it back if the phone is lost, reset or replaced.

Your entries are yours. You can change or delete them at any time, and you can delete your account and all data under Me → Account. Anyone who can open your iPhone can open your diary, so keep your phone protected with a passcode.

AI estimates

The AI tools in Fivebite Plus estimate foods, portions and protein from a photo, a label or your words, suggest food ideas, and put your week's numbers into plain words. They are provided through Anthropic, an AI company, and only after you allow them in the app.

  • AI can be wrong. Portions are hard to judge from a photo. Check the numbers before you save them. You can edit every line.
  • Food ideas are ideas, not advice. They are based on the protein you have left, your appetite today, the textures you chose, the foods you said you avoid, and what you have at hand. They do not take your health, your symptoms or your medication into account. You are responsible for choosing foods that are safe for you, including allergies and intolerances, and for reading product labels.
  • The weekly review restates counts from your own logs. It adds one simple goal for next week, about protein, water, check-ins or bites. It can make mistakes. It is not medical advice.
  • The AI is a software tool. It is not a person and it is not a health professional. There is no chat, and it does not answer questions about symptoms, medication or doses.
  • The AI tools have daily limits and may be unavailable at times.
  • Please do not put anything into a photo or a description that is not about food, such as other people or personal details.

Nutrition numbers

Protein and other values in the app come from public nutrition databases (USDA FoodData Central), labels you scan, your own entries and AI estimates. They are rounded and approximate. Portions are suggestions.

Apple Health

If you connect Apple Health, the app reads your weight and saves the weight and water you log, as described in the Privacy Policy. You control this connection in the Health app.

Fair use

The app is for your personal, non-commercial use. The AI tools have daily limits per person, the same on every plan, so the service stays fast for everyone. Please don't copy it, resell it or take it apart, don't try to break or overload the service, and don't use it for anything unlawful. We may suspend access for someone who misuses the service or breaks these terms.

We give you a personal, non-transferable license to use the app. The app, its texts, its design and the Fivebite name belong to Berrymore MB.

Changes to the app

We may add, change or remove features, and we may update the app at any time. We try to keep the service running, but we cannot promise that it will always be available or free of errors. If we ever close the service, we will try to announce it in advance.

Apple-specific terms

You get the app from Apple's App Store, so Apple asks us to make the following clear. In this section, "Apple" means Apple Inc. and its subsidiaries.

  • This agreement is with us, not with Apple. These terms are between you and Berrymore MB only. We, not Apple, are responsible for the app and what is in it.
  • License. Your license to use the app is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. Where Apple allows it, the app may also be used by other accounts linked to yours through Family Sharing.
  • Support. We are responsible for support and maintenance of the app. Apple has no obligation to provide any support or maintenance for it.
  • Warranty. We are responsible for any warranties for the app, to the extent they are not disclaimed in these terms. If the app fails to meet a warranty that applies, you may tell Apple, and Apple will refund the price you paid for the app, if any. As far as the law allows, Apple has no other warranty obligation for the app. Any other claims, losses or costs from such a failure are our responsibility.
  • Product claims. We, not Apple, are responsible for dealing with any claims about the app or your use of it. That includes product liability claims, claims that the app does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws, including in connection with the app's use of Apple Health (HealthKit).
  • Intellectual property claims. If someone claims that the app, or your use of it, infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and resolving that claim.
  • Legal compliance. You confirm that you are not located in a country that is under a US Government embargo or that the US Government has designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
  • Third-party terms. When you use the app, you must also follow any third-party terms that apply to you, for example your mobile data agreement.
  • Apple as a third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple has the right to enforce them against you as a third-party beneficiary.
  • Questions, complaints and claims about the app go to us, at the contact details at the end of these terms.

For the website and the app

No guarantees

We provide the website, the plan and the app as they are. We do not promise any health result, and we do not promise that every number is exact or that the service will be free of errors. Nothing in these terms takes away rights that the law gives you as a consumer.

Limits of liability

To the extent permitted by law, Berrymore MB is not liable for indirect or consequential losses arising from use of the site, the plan or the app. Nothing in these terms limits liability that cannot be limited by law.

Law

These terms are governed by the laws of the Republic of Lithuania. Consumers keep the protections of the law of the country or US state where they live.

Changes to these terms

If these terms change, the date at the top changes with them. If a change is important, we will announce it on this page before it takes effect, and by email if we hold your address.
